General terms and conditions of business

from Computer Systeme Schneider (hereinafter referred to as CSS).

1. SCOPE

The General Terms and Conditions (GTC) apply to all paid or free products and services provided by CSS. The provision of services is exclusively according to the GTC of CSS. By accepting an offer and making a payment, the GTC are recognized and accepted as legally binding. Deviating terms and conditions of the customer will only be considered if they are expressly confirmed by CSS in writing.

 

2. CONCLUSION OF A CONTRACT

A service contract is concluded exclusively when the customer settles the invoice attached to the offer, either in full or in part, according to the quotation. From this moment, the order is considered bindingly placed, and the contract becomes legally effective, thereby binding both parties. Withdrawal from the contract is regulated according to item 5 of the General Terms and Conditions.

 

3. OFFER AND DELIVERY TIME

An offer issued by CSS typically has a validity period of 30 days. CSS reserves the right to withdraw the made offer for economic reasons or due to resource-related issues. In particular, the presence of assured characteristics of the product must be expressly confirmed in writing by CSS. No warranty is assumed for the suitability of a product for a specific purpose unless this has been expressly confirmed in writing by CSS. Delivery times are subject to external partners and the scope of the service. CSS is not liable for damages if suppliers cannot meet the agreed deadlines. Shipping of the product within 14 days after receiving all necessary components is guaranteed. CSS informs the customer about unusual schedule shifts.

4. PAYMENT

CSS attaches an invoice to the offer. This invoice can also be used for partial payments according to the offer. CSS reserves the right to withhold the products until the total bill has been settled in full.

5. WITHDRAWAL

Withdrawal from the contract is only possible within a period of 7 days after the order or until all components for the order are completely present. If the customer decides to withdraw from the contract, the amounts already paid will be refunded minus a reasonable processing fee. Withdrawal after this period is not permitted.

6. RETURN POLICY 

Due to the customer-specific configuration of the order, a return is excluded according to the present GTC.

7. WARRANTY

Our warranty extends according to the applicable legal provisions for the first two warranty years. It is possible that some manufacturers offer additional warranty periods, which must be claimed directly from the respective manufacturer. If a manufacturer offers direct end customer support, it is the end customer's responsibility to report the defective item directly to the manufacturer or the manufacturer's service center. CSS exclusively handles warranty cases where the manufacturers do not provide direct end customer support. If a manufacturer undertakes the exchange of items directly with the end customer, it is no longer possible to register, exchange, or otherwise handle these items with CSS, as they are no longer the items originally purchased from CSS. In this case, the responsibility for the warranty handling lies with the manufacturer. Warranty cases include defects that are clearly due to inferior material or faulty manufacturing. The warranty period begins at the time of sale from the supplier. The end customer bears the costs for shipping repair shipments to and from CSS or directly to the manufacturer or to the service center of the manufacturer in Switzerland. 

8. WARRANTY PROCESS

The examination of a warranty case announced by the customer is carried out free of charge. However, if it is determined that the defect is not due to a hardware defect, CSS reserves the right to charge the customer for the work performed. An immediate examination is excluded and can take a longer period. There is no obligation on the part of CSS to provide a replacement device.

9. DATA PROTECTION

The collection, processing, and use of customer data are carried out according to the provisions of the Swiss Data Protection Act by CSS. Customer data is exclusively used within CSS and only passed on to third parties if this is necessary for the proper execution of the contract, for example, for billing.

10. JURISDICTION

Zurich (ZH) is determined as the jurisdiction for the assessment of all disputes arising from this contract. The buyer expressly declares that he submits to the agreed jurisdiction, waiving his ordinary place of jurisdiction. The applicable law is Swiss law.
